Operator: Green EV Charge Sdn Bhd (“chargEV”)

1.         OVERVIEW

The chargEV Referral Program (“Program”) is a loyalty initiative designed to reward existing users (“Referrer”) of the chargEV mobile application (“chargEV App”) for introducing new users to the chargEV App (“Referee”). By participating in this Program, both the Referrer (as defined in Paragraph 2 below) and the Referee (as defined in Paragraph 2 below):

  1. agree to be bound by these Terms and Conditions;
  2. agree to be bound by the chargEV General Terms of Use (“chargEV General Terms of Use”); and
  3. consent to their personal data being collected, processed, and used in accordance with the chargEV Privacy Policy (“chargEV Privacy Policy”). for the purposes of this Program.

2.         ELIGIBILITY CRITERIA

  1. Referrer: Must be an individual who is a registered account holder of the chargEV App with a mobile number verified during registration on the chargEV App.
  2. Referee: Must be an individual who has never previously registered an account or been associated with any account on the chargEV App, and must have not performed any charging sessions on their account on the chargEV app. chargEV may, in its sole discretion, disqualify any person it believes to be an existing or former user of the chargEV App, irrespective of the credentials used.

3.         REFERRAL MECHANISM & REWARDS

3.1       Referee Reward

Upon successful account creation on the chargEV App by the Referee and the entry of a valid Referral Code or redemption via clicking the unique secure link provided by the Referrer, the Referee shall be entitled to 1 unit of RM10.00 discount voucher (“Referee Reward”) which shall be made available in the My Vouchers section of the chargEV App. The Referee Reward shall be subject to the following conditions:

  • the Referee Reward shall only be applied to a single charging session on the chargEV App. Once applied, any unutilised portion of the Referee Reward shall be automatically forfeited and shall not be carried forward, refunded or credited to the Referee’s account;
  • any outstanding balance after deducting the Referee Reward shall be charged to the Referee's registered payment method. The Referee is solely responsible for ensuring sufficient funds or credit are available;
  • the Referee Reward shall only be valid for a period of 60 days from the date that the Referee Discount Voucher is made available in the My Vouchers section of the chargEV App. Failure to utilise the Referee Reward within the foregoing period results in automatic forfeiture;
  • the Referee Reward is valid only at participating charging stations as determined by chargEV from time to time. chargEV reserves the right to exclude specific stations, charger types, or locations without prior notice;
  • the Referee Reward cannot be combined with any other vouchers, promotions, discounts, or offers;
  • the Referee Reward is non-transferable, non-assignable and cannot be exchanged, sold or transferred for cash or any other form of consideration;
  • chargEV shall have the right to verify the validity of any Referee Reward redemption and to suspend, reverse, cancel or claw back any transaction in the event of any suspected or actual fraud, abuse, or non-compliance;
  • the Referee shall be responsible to ensure that the Referee Reward is correctly applied before commencing the charging session. No refunds, adjustments, or credits shall be provided for failure to apply the Referee Reward;
  • chargEV shall not be obligated and responsible to replace, reinstate, or compensate for any Referee Reward that have expired, been forfeited, or are otherwise lost due to user inaction or account issues.  

3.2       Referrer Reward

  • For every Successful Referral, the Referrer shall be entitled to 1 unit of 50% discount voucher (“Referrer Reward”). A "Successful Referral" means when a Referee who has successfully created a new account on the chargEV App and completed their first charging session where the transaction status is fully paid, as validated by chargEV's systems. 
  • The Referrer Reward shall be subject to the following terms:
  • each Referrer may earn a maximum of 5 units of Referrer Rewards per calendar month. Any Successful Referrals achieved beyond this limit shall not entitle the Referrer to any additional Referrer Rewards, and no compensation, credit, or carry-forward shall be provided for such excess referrals. The monthly quota resets on the first day of each calendar month;
  • the Referrer Reward shall only be made available in the My Vouchers section of the chargEV App only after chargEV has validated that the Referee has completed his/her first paid charging session on the chargEV App;
  • the Referrer Reward shall only be valid for a period of 60 days from the date the Referrer Reward is made available in the My Vouchers section of the chargEV App . Failure to utilise the Referrer Reward within the foregoing period results in automatic forfeiture;
  • the Referrer Reward shall only be applied to a single charging session (“Eligible Charging Session”);
  • the Referrer Reward shall be calculated based on the total cost of Eligible Charging Session subject to a maximum discount of RM20.00, whichever is lower;
  • the Referrer Reward cannot be combined with any other vouchers, promotions, discounts, or offers;
  • the Referrer Reward is valid only at participating charging stations as determined by chargEV from time to time. chargEV reserves the right to exclude specific stations, charger types, or locations without prior notice;
  • the Referrer Reward is non-transferable, non-assignable and cannot be exchanged, sold or transferred for cash or any other form of consideration;
  • chargEV reserves the right to verify the validity of any Referrer Reward redemption and to suspend, reverse, cancel, or claw back any Referrer Reward in the event that:
  • any Successful Referral is suspected or found to be fraudulent, invalid, or non-compliant; or
  • any Referee Reward is suspended, reversed, cancelled, or clawed back; and
  • chargEV shall not be obligated and responsible to replace, reinstate, or compensate for any Referee Reward that have expired, been forfeited, or are otherwise lost due to user inaction or account issues.         

4.      FRAUD PREVENTION AND AUDIT RIGHTS

  • chargEV maintains a zero-tolerance policy toward fraudulent, abusive or non-genuine activity within the Program. chargEV reserves the right, at its absolute discretion to withhold, reverse, cancel or claw back any Referee Reward and Referrer Reward under this Program, suspend any accounts on the chargEV App, or permanently ban any users in the event of any behaviour that is suspected or actual non-compliant with any terms and conditions stipulated herein, the chargEV General Terms of Use, the chargEV Privacy Policy or any applicable laws and regulations including, but not limited to:
  • creation of multiple accounts, whether directly or indirectly, by the same individual (sybil attacks);
  • the Referee Reward or the Referrer Reward are distributed via unauthorised commercial channels or paid advertising;
  • any manipulation of the transaction status or voucher redemption status, as detected by chargEV’s system.
  • self-referrals or referrals made using false, fictitious, or misleading identities; and
  • coordinated referrals, collusion, or participation in referral rings intended to exploit the Program.
  • chargEV reserves the right to conduct investigations and request supporting documentation or information to verify the legitimacy of activity in relation to or arising from the referrals under the Program. During investigations, any of the Referee’s and/or Referrer’s accounts will be temporarily suspended, and any Discount Voucher under the Program will be withheld pending the outcome of the investigation.
  • chargEV’s decisions in relation to fraud prevention and enforcement shall be final and binding. chargEV reserves the right to take further action, including legal recourse, where necessary.
  • All unused Referee Rewards and Referrer Rewards, including any partially used voucher, shall be immediately and automatically forfeited without compensation, refund, or reinstatement upon the suspension or termination of a user's account for any reason, whether initiated by the user or by chargEV.

5.         MODIFICATION AND TERMINATION

chargEV reserves the right to vary, delete, or add to any of the terms and conditions stipulated herein or to terminate the Program entirely, at any time without prior notice. Any such variation, deletion, addition or termination shall be effective immediately upon publication on the chargEV App or chargEV’s official website.

6.         LIMITATION OF LIABILITY

(a)        chargEV shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages losses or damages arising out of or in connection with the Program including any loss of opportunity, loss of rewards, loss of data, whether in contract, tort (including negligence) or otherwise.

(b)       chargEV shall not be liable for:

  • any failure, delay, or interruption in the operation of the Program, the chargEV App, or any charging station due to technical malfunctions, system outages, maintenance, connectivity issues, or circumstances beyond chargEV's control;
  • any loss, expiry, or inability to utilise any Discount Voucher, including where such loss arises from the Referrer's or Referee's failure to apply the Referee Reward or Referrer Reward correctly, voucher expiration, or exclusion of specific charging stations;
  • any loss or damage arising from any user error, including but not limited to incorrect application of the Discount Voucher, or failure to meet eligibility requirements;
  • any loss or damage caused by the acts or omissions of third parties, including but not limited to charging station operators, payment processors, or telecommunications providers.
  • In any event, chargEV's total aggregate liability to any Referrer or Referee under or in connection with this Program howsoever arising including negligence, shall not exceed the value of Discount Vouchers redeemed by such Referrer or Referee under this Program.

7.         GOVERNING LAW AND DISPUTE RESOLUTION

The terms and conditions herein shall be governed by the laws of Malaysia. Any dispute, controversy, or claim arising out of or relating to this Program shall be submitted exclusively to the jurisdiction of the Malaysian Courts.
